Energy Commission claim heading to the Court of Appeal

Further to our last email of 15 November 2024 and newsletter of 20 September – see here -our energy appeal to the Court of Appeal has now been brought forwards to the 29/30th January 2025.

The court has identified the appeal as being legally significant and high profile and so it is being live streamed for open public access.

The live-streamed broadcast of the appeal hearing will be accessible from the judiciary’s website here: https://www.judiciary.uk/you-and-the-judiciary/going-to-court/court-of-appeal-home/the-court-of-appeal-civil-division-live-streaming-of-court-hearings/.

The video will also be accessible from this website after the hearing.

Further Car Finance Appeal to the Supreme Court

In our last email we also told you about the landmark Court of Appeal decision in Car Finance Claims – where the Court of Appeal found that commission arrangements in motor finance deals sold to consumers were secret and illegal unless the borrower gave express consent. The hidden commission meant consumers paid more for car finance and it is being widely reported that future claims could cost the car finance industry billions of pounds in compensation.

This case is now proceeding to final appeal to the Supreme Court (the UK’s highest court) and will be heard on 1-3 April 2025. There are some significant overlapping issues with our energy commission appeal.

Further Car Finance Appeal to the Supreme Court

Both these appeals should start to bring some certainty to Energy Commission Claims-probably by around May time when the Supreme Court delivers its judgment in the Car Finance Claims.

We will keep you updated on developments as and when they happen.

Best regards
